Buffalo Lodging Associates, LLC has developed this Privacy Policy which details important information regarding the use and disclosure of user information collected on its buffalolodging.com website, mobile site, social media pages and related services. Effective Date: June 16, 2016 BUFFALO LODGING PRIVACY POLICY PLEASE READ THIS PRIVACY POLICY (“PRIVACY POLICY”) CAREFULLY AND IN ITS ENTIRETY BEFORE USING OUR SERVICES THAT LINK TO THIS PRIVACY POLICY.

1. GENERAL STATEMENT

Buffalo Lodging Associates, LLC (“Buffalo Lodging, “we”, “us”, or “our”) has developed this Privacy Policy which details important information regarding the use and disclosure of user information collected on our Buffalo Lodging website, mobile site, pages on social networks, and its related Buffalo Lodging sites and services linked to this Privacy Policy, whether accessed via computer, mobile device or other technology (collectively referred to as the “Services”).  Buffalo Lodging provides this Privacy Policy to help you make an informed decision about whether to use or continue to use the Services and the choices we offer for you to manage the information we collect.  By accessing the Services after the Effective Date you are deemed to consent to our then-current Privacy Policy. If you do not agree to this Privacy Policy or Terms of Use (“Terms”) which govern your use of our Services, please discontinue accessing or using the Services.

2. INFORMATION WE COLLECT

Information You Provide to Us  

You can browse our Services without telling us who you are or revealing any personal information.  However, we collect personal information you provide when you sign up for our Services, interact with Services or other users, or use various features of our Services.  For example, when you contact us, you choose to give us your personal information, such as your name, email address, phone number, and mailing address or zip code, and are not anonymous to us.

Information from Social Networks  

When using a third party social networking services (e.g., Facebook, Twitter, Instagram, Google +) (each and collectively, a “Social Network”), you may decide to connect your activity on our Services with your Social Network information and activity.  We (and that Social Network) may be able to identify you and to associate information received pursuant to the connection with information we already have about you.  Please review the Social Network’s privacy policy and choices for sharing information of any Social Network connected to our Services.

Surveys and Promotions

From time-to-time we may request information from you and other users via surveys, contests sweepstakes or other promotions.   Participation is voluntary. Information collected from you may be used as set forth in this policy and as set forth in the applicable terms or official rules.  Survey information will be used for the purpose(s) of the survey.

Mobile Device Information

If you’re using a mobile device to access our Services, we may collect your unique device identifier, device’s operating system, mobile carrier, or location.  Depending on the platform you use to access our Services (e.g., Apple iOS, Google, Android, Windows, etc.), you may be able to control from within the settings on your mobile device whether location data is collected.

Location Information

We collect your location information from your IP address or zip code.  We may also collect location information from you if you access Services through a mobile device if you permit this information to be shared.

Information from Other Sources

The information we collect may be combined with information from outside records (e.g., demographic information, navigation information, additional contact information) that we have acquired in accordance with the law.

3. INFORMATION COLLECTED THROUGH TRACKING TECHNOLOGIES

Usage Information

In addition to the information that you choose to submit to us, we and our service providers may use a variety of tracking technologies that automatically (or passively) collect certain information described in this Privacy Policy from your computer, mobile, or other access device whenever you visit or interact with the Services.  This may include the browser that you are using, the URL that referred you to the Services, all of the areas within the Services that you visit, key stroke data, mouse movement, scrolling, clicks, typing and the time of day, among other information (“Usage Information”).  We may associate information we collect through tracking technologies with personal information associated with your activity on the Services.  We may use tracking technologies for a variety of purposes, including:
  • Operationally Necessary.  We may use tracking technologies required for system administration, to prevent fraudulent activity or improve security. We may also collect user names and password information from you when you log in, as well as computer and/or connection information.
  • Performance-Related. We may use cookies or other tracking technologies to assess the performance of our Services, including as part of our analytic practices to improve the content offered through the Services.

4. HOW WE USE AND SHARE YOUR INFORMATION 

Use of Information by Us

Co-branded Areas

Certain areas on our Services may be provided to you in association with third parties who provide us with specialized content (“Co-Branded Areas”). Such Co-Branded Areas will identify the third party.  If you elect to inquiry about or register for services provided at these Co-Branded Areas, you either will be providing your information to both us and the third party or we might be providing your information directly to the third party.  Your information will be subject to this Privacy Policy as well as the privacy policy and practices of such third party. We are not responsible for the privacy practices of those third parties and we suggest you review the respective privacy policies of those third parties to learn more about their privacy practices.

Advertising

We may work with third parties to serve our advertisements on our site and on third party sites, to provide us with data collection, reporting, ad response measurement and site analytics and to assist with delivery of relevant marketing messages and advertisements.  These third parties may view, edit or set their own tracking technologies/cookies.  The use of these technologies by third parties is subject to their own privacy policies and is not covered by this Privacy Policy.  For more information, see Section 3, Information Collected through Tracking Technologies.

Location Information

We may use and share regional location in order to provide relevant content and advertising based on your location.  Information gathered from your use of the Services may be combined with information from third-party sources to identify your location by state and region.  If you enable location services for our Services, we may collect regional location data periodically as you use or leave open our Services.

Mobile Data

When you access the Services on a mobile device, we may use the information collected for any purpose set forth in this Privacy Policy.  For example, we may use the information to provide you with location-based Services, such as advertising, search results, and other personalized content.

Analyze and Aggregate Information

We use aggregate information about our users to analyze our Services and user behavior and prepare reports which we may share with third parties.

Offers and Promotional Messages

We may also use your mailing or email address to send you updates and communications about our Services or other messages, such as newsletters, changes to features of the Services, or special offers.  You will be given the opportunity, in any promotional email that we send to you to opt out of receiving such messages in the future.  We may also share your email address and information you provide us with third party marketers who we think can offer products, services or content of interest to you.  For more information on your choice and opt-out options, see Section 6 Choice and Opt Out below.

Legal Matters; Safety

We may, without your consent, access and disclose your information, any communications sent or received by you, and any other information that we may have about you as may be permitted or required by law (including, but not limited to, court order or subpoena), or to prevent or investigate suspected fraud, violations of our Terms, or activity that appears to us to be illegal or may expose us to legal liability.  Additionally, we may disclose your information in situations that we believe may involve potential threats to the physical safety of any person or property.

Sale or Transfer of Business or Assets

If Buffalo Lodging or an affiliated company, in whole or in part, is sold or disposed of as a going concern, whether by merger, sale of assets or otherwise, or in the event of an insolvency, bankruptcy or receivership, information of our users may be one of the assets sold or merged in connection with that transaction.  Information about our users may also need to be disclosed in connection with a commercial transaction where we or any one of our businesses are seeking financing, investment, and support or funding.

Transactional/Administrative Communications

We may send you notices from time to time including confirmations or Service-related or administrative announcements, for instance, if our Service is temporarily suspended for maintenance, or the delivery of a Service is delayed, or there are policy changes.  You may not opt-out of receiving these communications, which are not promotional in nature.

5. ACCESSING AND CHANGING YOUR PERSONAL INFORMATION

You can review and change the personal information you have provided to us by contacting us as provided in Section 8 below.

6. CHOICE AND OPT OUT

Opting Out of Promotional Messages

You may choose not to receive our promotional communications or you may opt out of our sharing your personal information with third parties for marketing purposes.  To opt out of promotional communications, simply click the unsubscribe link in the footer of any e-mail or newsletter and follow the unsubscribe instructions.  You may also contact us as set forth in Section 8 below.  It may take up to 10 days for us to process an opt-out request.

Timing and Third Parties

We will endeavor to comply with your requests as soon as reasonably possible but note that changes requested of us may not be effective immediately.  Unless required by law, we are not responsible for informing third parties with whom we have already shared your information of any changes requested pursuant to this section, or for removing information from or causing information to be removed from the databases or records of such entities.

Your California Privacy Rights

California Civil Code Section 1798.83, known as the “Shine the Light” law, permits California residents to request and obtain a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties.  To make such a request, please contact us at 3000 Davenport Avenue, Suite 101 Canton, MA 02021 .  For all requests, you must put the statement “Your California Privacy Rights” in the body of your request, as well as your name, street address, city, state, and zip code.  In the body of your request, please provide enough information for us to determine if this applies to you.  You need to attest to the fact that you are a California resident and provide a current California address for our response.  Please note that we will not accept requests via the telephone, mail, or by facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.

7. IMPORTANT DISCLOSURES AND PRACTICES

Storage and Retention

Information that you provide to us as described in this Privacy Policy or through the Services may be gathered and stored in one or more of our corporate databases.  We will retain logs and information about you for the purposes set forth in this Privacy Policy along with an archival copy of your information which might be used by us for recordkeeping and internal purposes, enforcing our Terms, complying with law, preventing fraud, assisting with investigations, resolving disputes, analyzing or troubleshooting programs, or taking other actions permitted by law.

Links to Other Sites

To the extent hyperlinks may be utilized to access external or third party sites, you should be aware that these external or third party sites are not controlled by us and, therefore, are not subject to this Privacy Policy.  We recommend that you check the privacy policies of these sites to determine how your information will be utilized by the proprietors of those third party sites.

Security

We implement reasonable security measures to protect against the loss, misuse and alteration of information under our control. However, despite our efforts, no system can completely guaranty that there will never be unauthorized access to your information, and your use of our Services indicates that you are willing to assume this risk.

A Note to International Users

The Services are hosted in the United States.  If you are using the Services from outside the United States, by providing your information on the Services, you are consenting to the transfer of your information to the United States for processing and maintenance in accordance with this Privacy Policy and our Terms.  You are also consenting to the application of United States law in all matters concerning the Services.

Children’s Privacy

The Services are directed to a general audience.  We do not knowingly collect personal information from individuals under 18 years of age and if we obtain actual knowledge that a user is under 18 years of age, we will take steps to remove that user’s personal information from our systems.

Changes to our Privacy Policy

We may change this Privacy Policy from time to time.  The most recent version of the Privacy Policy will always be posted on the Services, with the “Effective Date” posted at the top.  You should check the Services frequently for updates.  By accessing the Services after the Effective Date you are deemed to consent to our then-current Privacy Policy.

Disputes

If you choose to visit the Services, your visit and any dispute over privacy is subject to this Privacy Policy and our Terms including arbitration, limitations on damages, resolution of disputes, and application of the laws of the United States.
